1. Scope and agreement
These terms govern your use of nekophoto.com and the Neko Photo services and software made available by Andy Wong, except where a particular component or offering is governed by expressly identified separate terms. Review these terms before creating an account or using account-connected services. Any mandatory rights you have under applicable law remain unaffected.
If you are not legally able to enter this agreement on your own, obtain the involvement of a parent or legal guardian or do not create an account.
2. Product and availability
Neko Photo provides desktop photo-editing software and related website features. Ordinary editing is designed to occur locally. Downloads, updates, accounts, membership, licenses, support and feedback may require internet access.
Neko Photo is early-access (alpha) software. Every version released so far, including the current one, is an alpha build. Alpha software can change, contain errors, lose unsaved work or be withdrawn, and updates may be required to keep using it. Keep backups of photos and projects that matter to you.
Features can change, contain errors or be withdrawn. Roadmap items, proposals and estimated dates are not guarantees that a feature will be delivered. Compatibility and availability should be assessed against the requirements and release notes for the version you use.
3. Accounts and security
Provide accurate account information that you are authorized to use. Keep account credentials and access tokens private. Do not impersonate another person or access another account without authorization. Notify [email protected] if you suspect unauthorized use and use available session-revocation controls where appropriate.
Account access and any license rights are subject to the terms presented for the applicable offering. Do not resell, sublicense or redistribute access credentials as a service to others without written authorization.
4. Permission to use the software
Subject to these terms and any applicable component-specific licenses, you are granted a limited, non-exclusive right to install and use the Neko Photo software made available to you. This does not transfer ownership of Neko Photo's code, branding or other intellectual property.
Your rights in third-party or open-source components remain governed by their respective licenses. Nothing here removes permissions those licenses or mandatory law give you. You must not bypass access controls or license restrictions, distribute malware through the service, or falsely present an altered product as an official Neko Photo release.
Specific device allowances, transfer rights or offering-specific restrictions must be stated separately before they apply; these terms do not invent an undisclosed numerical device limit.
5. Early access and possible future paid plans
During early access, Neko Photo and its current account features are provided without charge. There is currently no paid plan, and no paid subscription is offered or created by using the software or holding an account.
A paid offering, such as a Neko Photo Pro subscription, may be added in the future. If that happens, its price, currency, features, duration, payment arrangements and any applicable renewal, cancellation and refund terms will be disclosed before you choose to purchase. Having a free account, an early-access key or free access during early access does not authorize a future charge or automatically enroll you in a paid plan. Charges will not be applied retroactively to use that was offered as free.
Any change affecting the free access you currently have should be communicated in advance, together with the options available. A future purchase must be based on the terms disclosed for that purchase, subject to applicable consumer protections.
6. License status and duration
Account features may display a membership tier, license status or expiry date. These records describe the access granted to the account and do not, by themselves, create a promise of permanent support, unlimited updates or access to every future product.
Where an offering uses a term such as “Lifetime,” its meaning and scope must be expressly defined for that offering before it is sold or relied on. These general terms do not define a lifetime purchase or retrospectively reduce rights already expressly granted.
Contact [email protected] if your displayed access does not match the access you believe you were granted. Do not attempt to work around the discrepancy by bypassing license checks.
7. Your photos and submitted content
You retain ownership of your photos and other content. Using Neko Photo does not transfer that ownership to the operator. You are responsible for having the permissions needed to edit, use or submit the content, including any rights of people depicted in it.
For content you voluntarily submit to the service, such as feedback, messages or avatars, you permit the operator to store, process and display it only as reasonably needed to provide the relevant feature, respond to you and operate the service, consistent with the Privacy Policy. This permission does not grant access to your entire local photo library.
Do not submit unlawful content, malicious files, unnecessary sensitive personal information or material that you are not authorized to share. Keep your own copies of anything important.
8. Feedback, roadmap and contribution activity
Feedback may be reviewed, categorized, answered or used to guide product improvements. Providing a suggestion does not oblige the operator to implement it or enter a confidential consulting relationship with you. Do not submit confidential ideas unless a separate agreement governs them.
Contribution points, feedback status, roadmap votes and similar indicators are product-participation records. Unless a separate offer expressly states otherwise, they are not money, employment compensation or a guaranteed entitlement to a paid license. Rules for any specific reward should be published before users rely on it.
9. Acceptable use
You must not:
- Attempt unauthorized access, credential theft, account impersonation or circumvention of access controls.
- Deliberately disrupt the service, overload endpoints or interfere with downloads and updates.
- Submit malware, exploit other users or misuse feedback and support channels.
- Infringe another person's intellectual-property, privacy or other legal rights.
- Misrepresent unofficial downloads or modifications as official Neko Photo releases.
If you discover a suspected security issue, contact [email protected]. Do not access other users' information or conduct disruptive tests. Obtain authorization before testing systems beyond ordinary intended use.
10. Third-party components and services
Neko Photo may depend on third-party components or link to external services. Their applicable licenses and terms remain relevant. An external link does not mean that the operator controls the linked service or guarantees its availability or practices. Review separate terms before installing a third-party plugin or sharing content with another service.
11. Updates, backups and service changes
Keep backups of original photos and important project files. Test workflows with copies where appropriate, especially while Neko Photo is in early access (alpha). Software updates can change behavior, compatibility or file handling; review relevant release notes.
The operator may maintain, change or discontinue features, subject to any specific commitments already made and applicable law. These terms do not promise uninterrupted service, support for every device or indefinite availability of a free offering. Changes to paid access, if introduced, must also respect the applicable purchase terms.
12. Suspension and termination
Access may be restricted where reasonably necessary to address misuse, security threats, a material breach of these terms or a legal requirement. Where practical and appropriate, the operator should explain the reason and provide a way to seek review. Immediate restrictions may be necessary for urgent security or legal reasons.
You may stop using the software or request account closure through [email protected]. Removing the local application does not automatically close your website account. Handling of remaining personal information is described in the Privacy Policy. Termination does not remove accrued payment obligations under a valid future purchase or rights that must survive under applicable law.
13. Warranties and responsibility
To the extent permitted by applicable law, the software and services are provided on an “as available” basis, without a promise that they will be error-free, uninterrupted or suitable for every purpose. This is especially relevant while Neko Photo is early-access (alpha) software. You remain responsible for appropriate backups and for checking output before relying on it.
Nothing in these terms excludes or limits liability or consumer rights that cannot lawfully be excluded or limited. These terms do not impose a specific monetary liability cap or a blanket waiver of all remedies. Any more specific allocation of liability should be reviewed for the applicable offering and law before publication.
14. Questions and disputes
Please first contact [email protected] with a clear description of the issue and the resolution you seek. We encourage a reasonable attempt to resolve concerns directly. This does not restrict access to any regulator, court or other remedy available under applicable law.
These terms do not require mandatory arbitration or designate an exclusive court. Any governing-law or forum provision will require separate operator confirmation and appropriate legal review, without removing mandatory protections that apply to users.
15. Changes to these terms
Revisions will be published with an updated date. Material changes should be communicated through an appropriate available notice before they are relied on. Introducing charges or materially changing a paid offering requires the specific disclosures described above; a general update to this page is not authorization to bill you.
